Mayor Bryan Shock called the March 28, 2019 Village of Attica Council meeting to order at 7:30 PM.

Roll Call: Nate Frisch, George Yakoubian, Justin VanAlstine, Louie Sanders, Ed Treft, and Kirk Stanfield Others present: Village Administrator Greg Martin, Solicitor Rick Palau

Approval of Warrants: Motion by Councilman Yakoubian, seconded by Councilman VanAlstine to approve the warrants for payment. Vote: 6-0 Motion carried. Approval of Minutes: Motion by Councilman Frisch, seconded by Councilman VanAlstine to approve the minutes.

Vote 6-0. Motion carried. Written & Oral Communication: Resident Terry Tusing stated his opinion that Attica needs a cop back in town. He stated that traffic laws are being broken and it’s unsafe to cross the street. He feels that residents need to open their eyes and pay attention. Councilman Yakoubian interjected that he agreed, also receiving a complaint about someone taking the curve too fast near his home. Tusing stated that he called the sheriff to request increased presence in Attica. They took his name and number but had not contacted him back at the time of the meeting. Tusing also stated he wasn’t sure how many in the room received Mrs. Briggs’s campaign letter, stating it wasn’t a survey but more of a campaign letter for her son or husband. Lynn Love questioned the wording of the ballot in May. She asked if the Village would be receiving funds immediately if it passes. Mayor Shock advised that if the levy passes in May, we would not see funds until next year. Solicitor Palau confirmed that it’s not possible to get funds immediately upon passage.

Public Safety: none

Streets & Properties: Village Administrator Greg Martin advised that DARS was in and cleared the tree root obstruction on the south side of west Tiffin. Martin also advised they are discussing paving and will be applying cold patch once the weather warms up. Martin also advised that he did contact someone about the house Councilman Treft inquired about last meeting. He has heard nothing back. Councilman Stanfield asked if he had been in contact with the people who own the house. Martin advised no, the county, stating the house had been condemned. Mayor Shock stated the previous owners did not pay taxes, so it went into foreclosure. Resident Terry Tusing spoke up to say that there is a trailer full of garbage just down the alley and asked Council to take a look. Village Administrator Greg Martin advised that all we can do is call the Health Department. He advised Tusing to call the Health Department as a resident. Councilman Stanfield asked if someone could write a ticket. Solicitor Palau advised it would have to be a certified law enforcement officer and that the mayor is not one. Councilman Frisch reported for the Flag Committee that new poles were needed. Approximate cost for the poles is $18, and about 40 would be needed. Frisch is hoping to have money donated to cover the cost of the poles and will put a reminder in the paper that residents can donate to the Flag Fund. The committee is hoping to get flags put up the first week in May.

Parks: Councilman Frisch inquired as to how the contract for the ballfield was coming. Solicitor Palau asked if Council just wanted something simple, like a waiver, where users carry their own insurance, and participants sign the waiver. Councilman Frisch advised he would get a set of rules for such waiver after the meeting. Councilman Frisch stated the ballfield association advised that the rounded fence in the outfield is moving and needs fixed. They would like to redo the entire fence, with the ballfield association paying for the cost of moving the fence. The fence would be moved in, approximately 15-20 feet, but Council would have to agree on the move. Village Administrator Greg Martin asked if the lights would have to be moved, but Councilman Frisch didn’t believe so. Councilman Sanders commented it would potentially only affect the softball tournament in the fall. Councilman Stanfield asked if maybe they would move it temporarily. Councilman Frisch advised that if the ballfield association wants to do it and pay for it, we should go ahead and let them do it. Motion by Councilman Frisch, seconded by Councilman Sanders to record that Council has no objection to moving the ballfield fence in 15-20 feet. Vote: 6-0. Motion carried. Councilman Frisch announced that last Tuesday, 3/19, he attended the Knights of Columbus meeting, along with Mayor Frisch and Pool Manager Glea Herr. They were asked to attend and given a $100 donation toward the pool. Motion by Councilman VanAlstine, seconded by Councilman Sanders to accept the $100 donation from the Attica Knights of Columbus for the pool. Vote: 6-0. Motion carried. Mayor Shock advised that he was contacted by Pool Manager Glea Herr regarding a lifeguard from last summer not receiving her certification reimbursement. He believes the name is Mallory Beamer, but only had a text from Herr and no other detail. Fiscal Officer Michelle Gullett advised she would check payment records to see if a check had been issued.

Trees: Village Administrator Greg Martin stated the found out the tree from the last meeting is, in fact, owned entirely by the Village. We now owe for the full cost of removal, $450. Martin also stated that there are “interested parties” to have the Buckeye tree down by the Methodist church removed. The reason why they wanted the tree removed is not known, but he said it does cause a mess at times with what drops from the tree. He couldn’t remember exactly when but recalled that an arborist was in town a few years back and was measuring the tree as a potential state record. Tree Committee Member Lance Drummond will do some research on that subject. Mayor Shock advised you may find that it takes an act of government to take down a Buckeye tree in this state. Councilman Stanfield thought that tree was also a candidate for the oldest tree in Attica. Tree Committee Member Lance Drummond advised that he will get trees planted this year and asked Council’s advice on where to start. It was discussed that starting from the inside out was best. Mayor Shock advised that Drummond double check with Village Administrator Greg Martin about things like water lines.

Finance & Rule: Cash balance of all funds $1,065,982.66. The February Bank Reconciliation was passed around for review and approval. Fiscal Officer Michelle Gullett advised the auditing firm picked up records on March 25th, and the audit has begun.

Old Business and New Business: 1 st reading of Resolution 2019-7, Resolution for Repayment of Advance from General Fund to Police Fund in the amount of $10,000, declaring an emergency. Motion by Councilman Sanders, seconded by Councilman VanAlstine to suspend the three read rule on RES2019-7. Vote: 6-0. Motion carried. Motion by Councilman Sanders, seconded by Councilman Frisch to declare an emergency on RES2019-7. Vote: 6-0. Motion carried. Motion by Councilman Sanders, seconded by Councilman VanAlstine to adopt RES2019-7. Vote: 6-0. Motion carried. Fiscal Officer Michelle Gullett advised there is a Public Records Training being held in Tiffin next Friday. The cost is free. She is available and registered. Advised if Council wishes, she can be made designee for the Village, covering Council and Mayor. Motion by Councilman Yakoubian, seconded by Councilman VanAlstine to declare Fiscal Officer Michelle Gullett as designee for Public Records Training. Vote: 6-0. Motion carried.
