Mayor Nathan Frisch called the August 13, 2020 Village of Attica Council meeting to order at 7:33 PM.

Roll Call: Lynn Love, George Yakoubian, Ed Treft, Louie Sanders, Kirk Stanfield (Excused: Tim Bulger) Others Present: Village Administrator Greg Martin

Approval of Warrants: Motion by Councilman Yakoubian, seconded by Councilman Sanders to approve the warrants for payment. Vote: 5-0. Motion carried.

Approval of Minutes: Motion by Councilman Treft, seconded by Councilman Yakoubian to approve the minutes. Vote: 5-0. Motion carried.

Written & Oral Communication: Resident Jim Love was present to request a sewer adjustment on his utility bill for power washing his driveway. Village Administrator Greg Martin stated that he thinks that Love has done this in the past. Councilman Stanfield brought up the ordinance regarding pool fills and asked if it was restricted to pools only. The ordinance was retrieved and read, and it was found that it doesn’t limit the sewer adjustment to pools only but also doesn’t address other situations. Stanfield would be against the sewer adjustment in this case, as it goes against the spirit of the ordinance which was meant to keep these sewer adjustments to pool fills only. He also suggested to check the minutes around the voting of that ordinance. Councilman Yakoubian agreed that it should be considered. Motion by Councilman Sanders, seconded by Councilman Treft to allow a sewer reduction for the water used by James Love to pressure wash his driveway and landscaping. Vote: 3-1, with Councilman Love abstaining and Councilman Stanfield voting no. Motion carried. Charlene Watkins from Seneca Regional Planning Commission was present to discuss updates on the ODNR Nature Works Grant received by the Village to fund the Veterans Memorial Park. She explained that SRPC would be advancing the Village $42,000 to get the project started until the Village can request the final reimbursement from the grant. The Village would need to enter a Memorandum of Understanding (MOU) stating the terms of the advance and repayment. This MOU was drafted by Solicitor Heyman and reviewed by SRPC’s counsel. Ordinance 2020-13 was presented to Council to authorize the mayor to enter into this agreement. Watkins also advised that the groundbreaking ceremony for the Park would be held Tuesday evening at 6pm. 1 st read ORD 2020-13: AN ORDINANCE AUTHORIZING THE MAYOR OF THE VILLAGE OF ATTICA TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH SENECA REGIONAL PLANNING COMMISSION FOR THE ADVANCEMENT OF FUNDS FOR THE VETERAN’S MEMORIAL PARK AND DECLARING AN EMERGENCY. Motion by Councilman Sanders, seconded by Councilman Love to suspend the three read rule on ORD 2020-13. Vote: 5-0. Motion carried. Motion by Councilman Sanders, seconded by Councilman Love to declare an emergency on ORD 2020- 13. Vote: 5-0. Motion carried. Public Safety: none

Streets & Properties: VA Martin advised that he gave the mayor a bid for street paving, and he is also going to contact Erie Blacktop for pricing. VA Martin stated there have been some issues with a tile on South Woodwind. Darr’s was in with a camera to try and locate the issue, but it couldn’t be seen. It does take water but very slowly. He is suggesting a new tile be installed between property lines from a point at which they know the line is good. Councilman Stanfield asked the status on the Beck Supplier annexation and what exactly would be annexed into the Village. VA Martin explained that some of Beck’s property and building is already in the Village. This annexation would just extend to include the full building.

Parks: Councilman Love has ordered the fence for the Myers Park project. The company is giving an estimate of about 5-6 weeks, due to the COVID pandemic. She confirmed that Tim Bowerman and the baseball club would be picking up the difference between the grant and the extra footage of fencing requested by the ball club. Love also stated that the portable toilet has been delivered to Myers Park. Love requested the status of the stone project for the parking lot and was advised by VA Martin that it has not been ordered yet. Love also noted that a wooden sign along 224 needs repaired and confirmed that the ball club takes care of painting the backstop fencing. VA Martin suggested getting basketball hoops installed at the park on Seneca Street.

Trees: none

Fire: Councilman Yakoubian reported: had meeting, paid bills. There was an issue with a volunteer that was discussed but no action taken. He also stated that he learned more about how the EMS and fire departments relate.

EMS: Councilman Love reported: had meeting; paid bills. The coordinator has turned in his resignation, and only 6 of the 8 volunteers are currently taking runs. The board feels they need to look into other options to ensure proper coverage.

Cemetery: Councilman Sanders reported: had meeting; paid bills.

Personnel: none Zoning Commission: none

Finance & Rule: Cash balance of all funds $ 1,326,439.85. The July Bank Reconciliation was presented for review and approval. Councilman Stanfield requested a YOY and YTD fund balance report. Village Income Tax: Councilman Yakoubian stated there hasn’t been anything new since the last meeting. Discussion was had about where and when to have a town hall meeting to discuss the income tax with residents, and Council would like to get the process started. Mayor Frisch advised that he feels Council needs to determine how to spend the income tax dollars prior to passing it so residents would have some transparency. Ideas brought up were streets, a fund to help with dilapidated properties, police, and a filter for the pool. Solicitor Heyman will be at the next meeting, and FO Gullett will ask her what the next step is before then. Charlene Watkins suggested putting notices for meetings where the three reads of the ordinance would take place to be put on utility bills or a postcard campaign. It was decided the three reads should probably take place at the two meetings in September and the first in October to give preparation and notice time. The meetings could start at 7pm those dates to allow extra time for public discussion.

Water & Sewer: The July Utility Adjustment Report was presented for review and approval. VA Martin and Councilman Yakoubian stated there was a tour given to Aqua Ohio a few weeks ago. They were impressed with the state of the water treatment plant and how things are run by the Village employees. At some point in the future, if the Village is serious about selling the water and/or sewer operations, someone would need to come and give an estimate of what it’s really worth. Councilman Love did state some concern about putting income tax money into water or sewer operations to sustain it. That’s not what she would want done. Councilman Treft wanted to know if it included the water lines, and it was confirmed it would include everything. Sewer may or not be up for sale, depending on the buyer.

Village Website & IT: none

Unfinished, Old Business and New Business: Mayor Frisch stated that things would be getting underway with the Veterans Memorial Park very soon. Part of the plans would be to move two telephone/power poles out and put in regular streetlamps. This would open things up and make it flow with the design of the park. The power for Village Hall comes out of one of those poles. It’s been estimated at a cost of $6700-$6900 for this project. The Legion would like to know if the Village would be interested in paying that cost. The General Fund would have funds, as not all carry over was appropriated, and that project would clean things up and allow better access to the street and park. Motion by Councilman Yakoubian, seconded by Councilman Treft to pay up to $7,000 for moving the poles/power as requested by the Legion. Vote: 4-1, with Councilman Stanfield voting no. Motion carried.
