Mayor Nathan Frisch called the May 28, 2020 Village of Attica Council meeting to order at 7:36 PM.

Roll Call: Lynn Love, George Yakoubian, Ed Treft, Louie Sanders, Kirk Stanfield, Tim Bulger
Others Present: Solicitor Heather Niedermeier Heyman

Approval of Warrants: Motion by Councilman Yakoubian, seconded by Councilman Love to
approve the warrants for payment. Vote: 6-0. Motion carried.

Approval of Minutes: Motion by Councilman Bulger, seconded by Councilman Yakoubian to approve the
minutes. Vote: 6-0. Motion carried.

Public Safety: none

Streets & Properties: VA Martin sent in a report in lieu of attending the meeting. He stated that painting
of the hydrant area on East Tiffin would be completed as soon as weather allows.


Councilman Stanfield expressed that he would like to enter a public complaint against “Greg and
company.” The storm drain in front of his house is plugged and when it rains, his basement floods.
Mayor Frisch questioned if this was the same storm drain that was recently cleaned by DARS and
whether or not any dye trace testing was done. Stanfield explained that he doesn’t know if it was
cleaned, that it’s not just the storm drain but also pipes. He stated that it’s not only his problem, but
others around town need cleaned as well. Resident Lance Drummond suggested getting some sort of
cover. After discussion, it was decided to have Greg come out and double check the catch basin to be
sure it’s clean and check the tile that goes to the ditch. Another suggestion was to get on a regular
maintenance schedule for catch basins.

Parks: Councilman Treft asked if we would be opening the park. Mayor Frisch clarified that the parks are
open, but ball clubs are not playing this summer. The Village is not in charge of them playing or not. The
pool will be closed. Councilman Stanfield suggested that we get around laws requiring lifeguards for the
pool by roping off a section to make it 2,000 sq ft and open the pool with no lifeguards. That was not
feasible and Councilman Yakoubian also reminded that the filter is on borrowed time.

Councilman Stanfield asked if we could put up a fence since the pool won’t be open. Councilman Love
advised we are applying for a grant to do so. FO Gullett advised the grant application was completed
and turned in but the application window doesn’t end until June 30. We will not know that status of our
application until after that time. It is something that can be discussed to continue if the grant is not
approved.

RES 2020-8: A RESOLUTION DECLARING THE NECESSITY FOR A RENEWAL LEVY AND DETERMINING TO
PROCEED TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION FOR PROVIDING PARK OPERATION (A
RENEWAL LEVY) AND CERTIFYING THE SAME TO THE BOARD OF ELECTIONS OF SENECA COUNTY, OHIO;
AND DECLARING AN EMERGENCY was presented. This is a second resolution necessary to proceed with
getting the park levy renewal on the ballot this November.

Motion by Councilman Sanders, seconded by Councilman Bulger to suspend the three read rule on RES
2020-8. Vote: 6-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman Bulger to declare an emergency on RES 2020-
8. Vote: 6-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman Yakoubian to adopt RES 2020-8. Vote: 6-0.
Motion carried.

Trees: Tree Commission member Lance Drummond reported that he has called around but is having
trouble connecting. It might be mid-June when he can get the information back.

Fire: Councilman Yakoubian reported: had meeting, paid bills. The budget was moved around to
accommodate purchasing more breathing apparatuses. Mayor Frisch also added the department should
be congratulated on receiving a $10k grant award.

EMS: Councilman Love reported: had short meeting, paid bills.

Cemetery: No meeting.

Personnel: none

Zoning Commission: none

Finance & Rule: Cash balance of all funds $ 1,213,516.28. FO Gullett also reported that Sherry Loos
advised that there is no program with OWDA to refinance loans currently and suggested reaching out to
local banks. Gullett will pass along the original loan resolution to Solicitor Heyman to review.

Village Income Tax update: Councilman Yakoubian advised that we need to move forward, one way or
another. We should probably invite someone from RITA back to get more information.

Water & Sewer: Councilman Yakoubian reported that he put out a few phone calls to NORWA and Aqua.
He would like to schedule a meeting with the water/sewer committee and have a representative attend
separately from each location to get more information. Councilman Stanfield stated that he spoke to
someone at Rural Water. He presented his version of the simplest variation with an estimate of not
likely more than $5 per gallon, stating we can buy water or sell the whole system. Several questions
were raised on the details and information used to obtain this estimate. Councilman Yakoubian advised
that we would want information from the company themselves and confirmed with the solicitor that
there wouldn’t be any issue to have someone come in to present information.


Councilman Love asked about utility delinquencies and if we are still sending out notices. FO Gullett
advised that she can’t give the number of customers or dollar amount, but she did know that notices
were still being sent so that customers are aware. Councilmen Stanfield and Yakoubian stated that some
sort of monthly report from the billing clerk might be good, like an accounts receivable aging report. This
would have to be coordinated with the billing clerk, depending on what her system can report out.

The May Utility Billing Adjustment Report was passed for review and approval.

Village Website & IT: none

Unfinished, Old Business and New Business: Councilman Stanfield wanted to know the report on his
ethics situation from the last meeting. Solicitor Heyman stated that she didn’t have an answer for him at
this time.
