Mayor Bryan Shock called the September 26, 2019 Village of Attica Council meeting to order at 7:31 PM.


Roll Call: Nate Frisch, George Yakoubian, Justin VanAlstine, Louie Sanders, Ed Treft, and Kirk Stanfield
Others present: Village Administrator Greg Martin


Approval of Warrants: Motion by Councilman VanAlstine, seconded by Councilman Sanders to approve
the warrants for payment. Vote: 6-0. Motion carried.


Approval of Minutes: Motion by Councilman VanAlstine, seconded by Councilman Frisch to approve the
minutes. Vote: 6-0. Motion carried.


Written & Oral Communication: Pastor Gary Click was present to introduce himself and his background.
He is running for State Representative.


Public Safety: none


Streets & Properties: VA Greg Martin advised that street paint has been ordered for painting the
crosswalks and downtown area.

Solicitor Rick Palau stated that back in 2016, the Village passed an ordinance to accept Woodwind Drive
into the Village, but the owner never deeded us the property. The ordinance was filed with the auditor
but the deed was never turned over. We keep getting tax bills for the property, which should be tax
exempt if owned by the Village. However, in 1976, the Prodens started a subdivision, but the plat was
never dedicated to public use. Even as the ownership was passed to a new owner, it was never
dedicated to public use. The city prosecutor advised Palau not to pay the tax bill, as it is not owned by
the Village. Palau believes the property is not actually owned by the Village since it was never deeded to
the Village, so it is not a Village expense. The property would have to be surveyed, and the plats would
have to be taken care of first. Someone else who may have an interest in it, such as a member of the
Proden family or MMB, or any homeowners’ association. Palau would like to write a letter to the county
auditor to advise that we do not actually own the property. He will also try to contact James Proden, the
last Proden name associated with the property. It does not mean the Village cannot plow the private
drive, but Palau would not advise signing off on property ownership until everything is settled out. He
asked if Council would be OK with drafting letters to James Proden and the county auditor. Mayor Shock
advised to draft the letters and send them out.


Parks: VA Martin stated the crew may start winterizing the park if all events are done for the year.

Personnel: noneZoning Commission: VA Martin stated that he is working on the situation on Venice St. A letter was sent
to the owner, but the owner advised the building was rented and he wasn’t aware the condition was
that bad. The tenant started to clean up the property but stopped. Martin confirmed it is zoned for
commercial use. He also stated that part of the property is in Venice Township. If the cars were moved
to that portion of the property, the Village would not be able to do anything about it. Councilman
Yakoubian asked about unlicensed vehicles, but Martin advised we already have them and were being
enforced when there was a police department. We are currently relying on zoning ordinances to be sure
they are complying. Solicitor Palau advised the township could do something by means of resolution,
but they would have to handle that if the cars were moved to township property. Councilman Stanfield
asked if there was any chance of putting a fence around the property. Martin advised he’s not sure what
the owner’s plan are.


Finance & Rule: Cash balance of all funds $ 1,021,360.88. FO Michelle Gullett confirmed that she will be
attending a Village Fiscal Officer training session on Wed 10/2. Gullett also advised the 2017-2018 audit
was released on 9/19. There were no material weaknesses or findings.


A 2020 budget for the Village was prepared and passed to Council to review. It was noted that a park
levy is up for renewal next year. Councilman Stanfield questioned the balances available on January 1st
and why the starting balance wouldn’t equal the end of this year. Gullett explained that they were
talking about two different reports. The budget is an estimate and a guess on what we should be
spending.


Motion by Councilman VanAlstine, seconded by Councilman Sanders to adopt the 2020 budget outline.
Vote 5-0, with Councilman Stanfield voting no. Motion carried.


1st Read of RES 2019-11, RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE
BUDGET COMMISSION, declaring an emergency.


Motion by Councilman Frisch, seconded by Councilman VanAlstine to suspend the three read rule. Vote:
6-0. Motion carried.


Motion by Councilman Sanders, seconded by Councilman Frisch to declare an emergency. Vote: 6-0.

Motion by Councilman Frisch, seconded by Councilman VanAlstine to adopt RES 2019-11. Vote: 6-0.

Water & Sewer: VA Martin announced there will be hydrant flushing starting on 9/30.


Village Website & IT: none


Unfinished, Old Business and New Business: Councilman Frisch stated that we need to think about
whether or not we are going to try and have a police department. If so, we need to figure out a levy or
way to fund. If not, we need to figure out what we are going to do with that side of the building and
equipment. Mayor Shock suggested forming a committee to survey residents. He appointed Lynn Love
as the head of the committee, as well as Louie Sanders. Councilman Frisch volunteered to help if
needed. Shock advised Love would need to report at the next meeting.FO Gullett brought up a previous discussion about the subscription for the Ohio Basic Code Solicitor
Palau advised to just get one copy. That is possible now, as the minimum order is no longer in effect,
and you can order just one copy. The price of one single copy would be $425. Councilman Yakoubian
asked how accurate the Ohio Lawriter site is. Councilman Stanfield suggested to team up with
surrounding villages to get discounted pricing. Gullett advised we don’t have to decide until November,
and that is something she can look into.


Discussion was had on Trick-or-Treat for the Village. It was decided that Trick-or-Treat will be on Sunday,
October 27th, from 4:00pm-5:30pm.


Motion by Councilman VanAlstine, seconded by Councilman Sanders to set 2019 Trick-or-Treat for
10/27/19, 4:00p-5:30p. Vote: 6-0. Motion carried.
