Mayor Bryan Shock called the January 26, 2017 Village of Attica Council meeting to order at 7:30PM.

Roll Call:  Nate Frisch, George Yakoubian, Kirk Stanfield, Jeff Painter, Gary Jordan, Jeff Love.  Others present:  Village Administrator Martin, Solicitor Palau, Police Chief Turner,  Blue Line Solutions Ty Simms and Robert Peters, residents M/M Lance Drummond, Paula Karr, Scott Dorris and Charlene Watkins of Seneca Co. Regional Planning.

Motion by Councilman Love, seconded by Councilman Jordan to approve the warrants for payment.  Vote: 6-0.  Motion carried.

Motion by Councilman Yakoubian, seconded by Councilman Painter to approve the minutes as presented.  Vote: 5-0, with Councilman Jordan abstaining.  Motion carried.

Written & Oral Communication:  Charlene Watkins (SRPC) informed Council of CDBG monies available for application for Seneca Co, and is working on including the Eagles building for removal, ground (grade) fitted and green space availability.  Two other projects will be submitted with this proposal, what is Council’s wishes for this neighborhood revitalization?  Discussion led to ideas of water line replacements, lighting of downtown, sidewalk repairs, planters, ballfield lighting, etc.  The projects must tie together with the Eagles building, close in proximity and benefit low to moderate income families.  The Village will need to complete an income survey (training from SRPC), with applications in by the end of June.  Council indicated V.A. Martin and F. O. Krebs be the contact points for the project.   Charlene will also research other vacant/derelict properties within the Village for consideration of the monies available from the land bank (non- commercial).  Paula Karr has been instrumental in helping Charlene with the project demolition of the Eagles building, stating that is not just an eye sore to the community, but a real hazard to all. We appreciate her efforts.   The CDBG application is competitive bidding, so no guarantees that it will be funded.  Ms. Watkins hope that these projects will be awarded, and turn the green space over to the Village (from the County) upon completion of the projects.

Public Safety:  Chief Turner has received numerous complaints of a woman claiming need of monies for a sick mother.  Residents, Churches and Businesses are urged to call the Police/sheriff about this because it is a scam, don’t give her money, and the community needs to be aware of such instances. 

Motion by Councilman Yakoubian, seconded by Councilman Frisch to enter into Executive Session for contractual agreement discussion.  Time:  7:59PM.  Vote: 6-0.  Motion Carried.  Motion by Councilman Yakoubian, seconded by Councilman Love to enter out of Executive Session into Regular Session.  Time: 8:14PM.  Vote:  6-0.  Motion carried.  Solicitor Palau suggested Council delete section 15 (page 9 of 12) in the Blue Line Solutions contract, and insert the rate of $12.72 per hour (part-time officer) to $28.04 per hour (full-time officer) in the contract under officer reimbursement (page 8 of 12, Section 11, iii, b).  Motion by Councilman Yakoubian, seconded by Councilman Stanfield to remove Section 15 (page 9 of 12) and add rates of officer reimbursement $12.72 per hour to $28.04 per hour in Section 11,iii, b (page 8 of 12) in the contract with Blue Line Solutions.  Vote: 6-0.  Motion carried.

Streets & Properties:  Paving quotes are being obtained for several projects:  insurance claim (semi driver’s) for damage caused by the semi driving on back streets and getting stuck, causing damage to the street, and several surrounding residents; water break repairs, sewer settles and Heyman Drive and the Committee will look at potential streets for paving in 2017, with funding allocated in the appropriations.  Miller Cable will meet with V.A. Martin 1-24-17 to finalize the plans for the S. Rts. 4/224 traffic signal project.

Finance & Rule:  Total all fund:  $834,778.14.  Property tax bills have been received for AVMP parcels and WW Lagoon parcels (awaiting Tax Exemption process) and Myers Park and WW plant ditch assessments for payment.  The N/S Woodwind Street tax bill ($29,198.09 for back- years taxes) will not be paid and is also awaiting the Tax Exemption process.  Solicitor Palau was given a copy of this past-due tax bill.  An audit of the CDBG project funding of the $500,000 grant for the lagoons was held today, with Tim Leasure (CDBG) reviewing project information/expenses and ending with  Mr. Leasure accompanying V.A. Martin to the lagoons for photos.

Water & Sewer:  W:  the latest EPA regulations concerning lead/copper  were received and we have until 3-9-17 to respond how we will map(household diagrams of piping, faucets, etc.) out the potential areas involved.

Unfinished, Old Business, New Business:

To clarify Councilman Stanfield’s questions on O #2017-1 (water capital increase) from 1-12-17, his reference of O #1988-4, does not apply at all;  O #1994-7 w. capital charge, replaced by O# 1995-02; replaced by O# 2009-10; replaced by O#2009-50 ($2.65 monthly surcharge on the w/s rate schedule).  Ordinance # 2017-1 will reference O# 2009-50 (not 10) as the amending Ordinance #).  Councilman Stanfield asked about ORC 731.30 and Solicitor Palau responded the passage by emergency needing five affirmative votes.  2nd reading of Ordinance 2017-1 was held, noting amending Ordinance 2009-50.  Motion by Councilman Love, seconded by Councilman Frisch to suspend the three read rule on Ordinance 2017-1 (water capital surcharge, a $2.00 increase on the w/s rate schedule).  Vote:  5-1, with Councilman Stanfield voting No.  Motion by Councilman Frisch, seconded by Councilman Yakoubian to declare an emergency on Ordinance 2017-1.  Vote:  5-1, with Councilman Stanfield voting No.  Motion by Councilman Yakoubian, seconded by Councilman Love to adopt Ordinance 2017-1, the $4.65 per month water capital surcharge on the water/sewer rate schedule, effective 1-1-2017.  Vote:  5-1, with Councilman Stanfield voting No.  Motion carried. 

2nd Reading of Ordinance 2017-2, Automated Speed Enforcement & Civil Penalties for violations, with the amount of $120.00 (changed from $125.00) for civil penalty, and the contract with Blue Line Solutions, removing section 15 (page 9 of 12) and inserting $12.72 per hour part-time officer to $28.04 per hour for full-time officer, in Section 11,iii,b (page 8 of 12), as voted upon earlier this meeting under Public Safety.

1st Reading of Resolution 2017-3 was given.  Advance request of $20,000 from S.C. R.E. taxes for Police Operations.  Motion by Councilman Yakoubian, seconded by Councilman Frisch to suspend the three read rule on Resolution 2017-3, $20,000 advance request.  Vote:  6-0.  Motion carried.

Motion by Councilman Frisch, seconded by Councilman Yakoubian to declare an emergency on Resolution 2017-3.  Vote:  6-0.  Motion carried.

Motion by Councilman Yakoubian, seconded by Councilman Love to adopt Resolution 2017-3, the $20,000 advance request from the Seneca Co. Auditor.  Vote:  6-0.  Motion carried.

Councilman Frisch asked the other members what their thoughts were for the additional two projects to go with the CDBG application of the Eagles building demolition.  Discussion leaned toward the lighting and sidewalk repairs in front of the Eagles current site, with public information in the form of a flyer and/or meetings to explain the income survey and its importance to this funding application.  Motion by Councilman Yakoubian, seconded by Councilman Jordan to include sidewalk repairs/replacement and lighting in front of the Eagles building to be the two projects for the CDBG application for the Village of Attica.  Vote:  6-0.  Motion carried.

Thanks to Mr. & Mrs. Lance Drummond for their kind donation of three framed documents he presented to the Village:  The Bill of Rights; Declaration of Independence and the Constitution.  V.A. Martin will hang them in Village Hall.
