Mayor Bryan Shock called the February 14, 2019 Village of Attica Council meeting to order at 7:33PM.

Roll Call: Nate Frisch, George Yakoubian, Justin VanAlstine, Louie Sanders, Ed Treft, and Kirk Stanfield

Others present: Village Administrator Greg Martin

Approval of Warrants: Motion by Councilman Yakoubian, seconded by Councilman VanAlstine to approve the warrants for payment. Vote: 6-0 Motion carried.

Approval of Minutes: Motion by Councilman Frisch, seconded by Councilman VanAlstine to approve the minutes. Vote 6-0. Motion carried.

Written & Oral Communication: Mayor Shock congratulated the Seneca East girls’ basketball for an outstanding season.

Request for clarification of the penalties for a utility customer who set up payment arrangement and failed to pay their utility bill was received from Sheryl Hamilton. A payment plan was set up for a customer and the customer is not paying anything on the regular bill or the past due portion of the bill that they had set up a payment plan on. Sheryl would like to know how to handle the situation. The same people are still at the property, they are just not paying. These customers have broken the agreement on the water bill, penalties have not been assessed, how should Sheryl reassess penalties on past due bill? The council decided a 10-percent penalty on the amounts in arrears would be imposed monthly plus paying the current fees.

Public Safety: none

Streets & Properties: Village Administrator Greg Martin reported that a service water line on West Tiffin Street has been replaced and repaired after discovering a lead line. RA Bores was hired to do the work. The Village paid for our portion that was replaced, and the home owner paid for their portion that was replaced. DARS has been called in to start working on a catch basin with tree roots suspected of entering the tile. Greg also stated that they have warmed up some cold patch and patched some of the really deep potholes.

The Solicitor was emailed information about the Legion and the names to put the property under. It was suggested the council include a clause in the contract with the American Legion land transfer of the empty lot stating the property would revert back to the Village in case the organization should disband.

Parks: none

Trees: none

Fire: had meeting paid bills

EMS: had meeting paid bills

Cemetery: had meeting paid bills

Personnel: Michelle Gullett for new fiscal officer.

Zoning Commission: Issued a couple of permits for garages and shops.

Finance & Rule: Cash balance of all funds $1,032,852.28. 2nd read of Ordinance 2019-3: An Ordinance establishing rates of pay for Village Employees. 1st read on Ordinance 2019-5: An Ordinance approving, adopting, and enacting American Legal Publishing’s Ohio Basic Code, 2019 Edition, as the Code of Ordinances for the municipality of Attica, OH, and declaring an emergency. 1st read ordinance 2019-6: an Ordinance hiring Michelle Gullett at the rate of $16,500 a year as Fiscal Officer for the Village of Attica, Ohio as of February 6, 2019 A.D.: and declaring an emergency.

Motion by Councilman Sanders, seconded by Councilman VanAlstine to suspend the three read rule on ordinance 2019-6. Vote 6-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman VanAlstine to declare an emergency on ordinance 2019-6. Vote 6-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman VanAlstine to adopt ordinance 2019-6. Vote 6-0. Motion carried.

Bank statement for January 2019 was reviewed and signed. Utility billing adjustments for January 2019 were reviewed and signed.

Water & Sewer: none

Village website & IT: Councilman George Yakoubian is going to look into how to include an AEP app to the village website for residents to report street light outages.

Unfinished, Old Business and New Business: The time frame to get the front desk window installed will be 5-7 weeks. Mayor is going to keep police sign on the police door, the door will remain locked, may add sign “call 911” and tape to door.

Motion by Councilman Sanders, seconded by Councilman Frisch to enter into an executive session. Time: 8:21 PM. Vote: 6-0. Motion carried.
