Mayor Nathan Frisch called the September 8, 2022 Village of Attica Council regular meeting to order
at
7:40 PM.
Roll Call: Tim Bulger, Kirk Stanfield, Louis Sanders, Ed Beamer, Lynn Love (arrived @ 8 pm)
Others Present: Billing Clerk, Robin Bulger
Approval of Warrants: Motion by Councilman Bulger, seconded by Councilman Beamer to approve the
warrants for payment. Vote: 4-0. Motion carried.
Approval of Minutes: Motion by Councilman Beamer, seconded by Councilman Bulger to approve the
minutes. Vote: 4-0.
Written & Oral Communication: Dave Conley of 5 Mill St. was present due to his water bill being
$800+ for current two-month billing period. Mr. Conley explained his bill is normally $130- $140
monthly. He raised concerns with the Billing Clerk, Robin Bulger, after receiving the bill. Mr.
Conley stated Dakota visited his property and they looked for seepage and checked the toilets and
showers for leaks failing to find a reason for the high bill. Water personnel decided to swap out
the meter. Robin stated his usage from June to August was 37 units, which amounted to $834. Mr.
Conley asked Council to consider that his water meter was old and therefore running fast.
Councilman Bulger made the motion to charge Dave Conley $250 for his water and sewer utility for
the two-month period, stating personnel should follow up over the next two weeks to monitor the new
meter and situation, Councilman Sanders seconded. Vote: 4-0 motion carried.
Public Safety: none
Streets & Properties: ORD 2022-12 ODOT Preliminary Legislation Mayor Frisch let Council know that
ODOT would like to pave Route 4 but Council needs to authorize the project by passing preliminary
legislation as an emergency to proceed. Councilman Sanders asked if there would be any cost to the
Village. Councilman Stanfield stated there would not be any cost unless Council decided to add some
upgrades/frails to the project. Councilman Beamer pointed out the legislation states the State
would bear 100% of the cost. Councilman Stanfield asked if there was anything that needs to be done
along Route 4 that could be completed in conjunction with the paving project. Councilman Beamer
stated lead lines along Route 4 could be identified and possibly swapped out. Mayor Frisch said
without knowing the date of the project, it would be hard at this point to plan.
Councilman Sanders made the motion to suspend the three-read rule on ORD 2022-12, Councilman Beamer
seconded. Vote: 4-0. Motion carried.
Councilman Sanders made the motion to declare an emergency on ORD 2022-12, Councilman Beamer
seconded. Vote: 4-0. Motion carried.
Councilman Sanders made the motion to adopt ORD 2022-12, Councilman Beamer seconded. Vote: 4-0.
Motion carried.
Councilman Bulger stated he received a call about high grass. He suggested the caller report the
weeds to the Sheriff’s Department. The issue was taken care of. Furthermore, Councilman Bulger
asked who would be responsible for high weeds on properties that are vacant. Mayor Frisch stated it
would be the responsibility of the property owner.
Parks: Councilman Stanfield requested Council start considering the swimming pool and whether or
not to get it in good working order for the 2023 season. Mayor Frisch asked what if everyone wants
to get rid of it? Councilman Stanfield said let’s do that now before the next election. Mayor
Frisch clarified that he doesn’t know if that is how people feel. Councilman Love stated that the
levy money doesn’t just go to the operation of swimming pool, it is also used on the ballfields and
parks. She stated there were games taking place tonight when she passed by. She also stated the
$18,000 produced by the levy does not go far with the overhead costs associated with personnel and
maintenance. Councilman Stanfield maintained his position on researching the expenses to open the
pool. Councilman Sanders stated the pool would need to be filled to test the infrastructure.
Councilman Stanfield didn’t think that would be a major expense. Councilman Stanfield stated does
anyone know what the cost would be to repair the pump. Councilman Beamer stated he imagined Gary
would have an idea what repairs were needed
when the pool was closed up last. Council Stanfield hypothetically stated $30,000 as a repair cost.

Councilman Beamer said if $30,000 is put into the pool pump and then we are unable to staff it with
lifeguards, then what?! Mayor Frisch stated people may not even patronize the pool since it has
been closed for the last two years. Councilman Stanfield stated, “Make a call on the swimming pool…
the transparent way.” Councilman Beamer asked Councilman Stanfield what his decision would be on
the swimming pool. Councilman Stanfield said raise the money from taxes, fix the pool, and open it
up at a reasonable rate so the residents can attend if they so choose.
Trees: Councilman Stanfield inquired about the trees that need removed or repaired. Councilman
Beamer stated there was $1800 to handle problem trees. Councilman Stanfield exclaimed, “Look at
your street fund. It has $82,000.” Councilman Beamer frustrated, offered Councilman Stanfield the
opportunity to handle the trees.
Fire: Councilman Bulger reported there is a meeting scheduled for next week. AVR was called out
today on a mutual aid run in the ten thousand block of 162 for a house fire.
EMS: None
Cemetery: Councilman Sanders reported there is a meeting scheduled for next week.
Personnel: Councilman Bulger asked if we need anybody. Councilman Beamer responded, “You better
start looking for a water guy”. Councilman Bulger asked, “You mean like a water supervisor?” Mayor
Frisch stated the person would need a class III water operator license. Councilman Bulger directed
the FO to post the position on whatever site we use. FO Hatfield took this as an opportunity to let
Council know amended appropriations would be necessary with the increase in Dakota’s wages, the
payout of Gary’s comp time, and due to operating with two fiscal officers for longer than
anticipated.
Zoning Commission: Joe Brown was in attendance. He recently bought the apartment building at 100
Ash Dr. Mr. Brown requested council approve the grandfathering of the existing apartment building
because current zoning does not allow multifamily units. He was also interested in support of a
20-foot easement / right of way for 14 White Birch Dr., the property to the south to allow them
access to their property.
Councilman Beamer made a motion to approve the grandfathering of the 8 units at 100 Ash Dr. barring
any future additions to the structure. Additionally, unless otherwise stated in the zoning code,
Councilman Beamer included in his motion approval of a 20-foot easement / right of way for the
owner/ residents of 14 White Birch Dr. Councilman Bulger seconded the motion. Councilman Love
abstained due to being absent for the discussion. Vote: 4-0 Motion carried.
Finance and rule: $1,532,583.93 All funds includes CDs and reserved or restricted funds, and debt
reserve funds. Councilman Bulger asked when budget discussions would take place. Mayor Frisch
stated personnel handles that.
Water & Sewer: Councilman Beamer sent the sample packet to Heather. He has not heard back yet.
Village Website & IT: none
Unfinished, Old Business and New Business: Councilman Bulger made a motion to have trick or treat
on Sunday, October 30 from 4-6 pm, Councilman Beamer seconded. Vote:5-0. Motion carried.
Councilman Bulger recognized the passing of Tree Commission member, Lance Drummond and his years of
service with no expectations in return. Lance was a kind man, who was always happy to help. He will
be missed!
Next meeting: Monday, September 19, 2022 at 7:30 PM Councilman Beamer and Councilman Sanders were
both unavailable for the September 22ⁿᵈ meeting.
