Mayor Nathan Frisch called the August 25, 2022 Village of Attica Council regular meeting to order at 7:35 PM.
Roll Call: Tim Bulger, Kirk Stanfield, Louis Sanders, Ed Beamer, Lynn Love
Others Present: Solicitor Heather Niedermeier Heyman

Approval of Warrants: Motion by Councilman Bulger, seconded by Councilman Beamer to approve the warrants for payment. Vote: 5-0. Motion carried.
Approval of Minutes: Motion by Councilman Beamer, seconded by Councilman Bulger to approve the minutes. Vote: 4-0. Motion carried with Councilman Love abstaining.

Written & Oral Communication: none

Public Safety: Councilman Bulger presented council with an advertisement for electronic radar speed signs similar to the ones in Republic. Councilman Beamer thought they were expensive.

Streets & Properties: none

Parks: Councilman Love explained she received a couple of estimates for signage in the parks that would satisfy the recommendations from PEP. She is working on quotes for the pea gravel, asking if the Village had the capability to haul stone to avoid freight charges. Councilman Love stated the bleachers were delivered and she hoped to get a group together to assemble them. Mayor Frisch volunteered to help.

Councilman Love pointed out that replacing the bleachers was mentioned in the PEP recommendations, as well so they came at a good time.

Trees: Councilman Beamer stated the ash tree in Central Park had large limbs coming out of it and wondered if the expense to remove it would be a parks expense. He also said he had the sample bid documents from Stephanie from ODNR he was reviewing.

Fire: Councilman Bulger stated there was a regular meeting last week. Bills were paid. AVR had 20 fire runs in the last month. The fair went well with 2 medical assists. Councilman Bulger explained they have several trucks needing repaired, so they are currently pricing brush trucks but finding vehicles are not available.

EMS: Councilman Love stated the Joint Ambulance District met August 24 and paid bills. One squad is back in service.

Cemetery: None

Personnel: Councilman Love was very complimentary of the new Billing Clerk, Robin Bulger, for taking initiative in learning her new position and going above and beyond. Mayor Frisch also said he heard great things about her too from an employee.

Councilman Bulger asked the Solicitor if she thought the personnel handbook was ready to go. The Solicitor asked for clarification on comp-time. Councilman Bulger explained it should be stated no comp-time for salaried employees. Councilman Beamer clarified stating no comp-time or overtime for salaried employees. Mayor Frisch asked how they would handle salaried employees who work holidays. Councilman Beamer stated if the employee works the holiday they would be entitled to another day off. The Solicitor asked if council wanted to put a cap on comp-time payout. Councilman Bulger suggested capping comp-time earned to 240 hours and a maximum of 50 hours would be able to be cashed out annually.

3rd Read of Ordinance 2022-11, AN ORDINANCE APPOINTING A VILLAGE SOLICITOR

Motion to adopt by: Councilman Bulger, seconded by Councilman Beamer. Vote: 5-0. Motion carried.

Zoning Commission: Mayor Frisch explained the owners of 100 S. Ash Drive requested to do a lot split to have the ability to sell a portion of their property with apartments on it. The property is currently 3 permanent parcels, the split would create 5 permanent parcels. He asked if anyone had any objections.

Motion by: Councilman Love, seconded by Councilman Bulger to approve the lot splits. Vote: 5-0. Motion carried.

Finance & Rule: Cash balance of all funds $1,545,086.46

All funds includes CDs and reserved or restricted funds, and debt reserve funds.

Water & Sewer:

Councilman Beamer met with Aqua Monday night. They gave him a sample draft proposal. He intends to send that to the Solicitor. Aqua did say they are not interested in the stormwater only the water and sewer.

Motion by: Councilman Bulger, seconded by Councilman Love to enter into executive session to discuss pending litigation related to Councilman Stanfield. Time: 8:25 pm. Vote: 4-0. Motion carried.

Motion by: Councilman Bulger, seconded by Councilman Sanders to exit executive session. Time: 8:35 pm. Vote: 4-0. Motion carried.

Unfinished, Old Business and New Business: Bonnie did announce this would be her last meeting for sometime with daylight hours becoming shorter.
