Mayor Nathan Frisch called the July 28, 2022 Village of Attica Council regular meeting to order at 7:35 PM.
Roll Call: Tim Bulger, Kirk Stanfield, Lynn Love, Ed Beamer, Louis Sanders

Approval of Warrants: Motion by Councilman Bulger, seconded by Councilman Love to approve the warrants for payment. Vote: 5-0. Motion carried.
Approval of Minutes: Motion by Councilman Beamer, seconded by Councilman Bulger to approve the minutes. Vote: 4-0 with Councilman Sanders abstaining due to being absence at the July 14th meeting. Motion carried.

Public Safety: none

Streets & Properties: Councilman Beamer expressed pleasure with the expense from the repair of route 4 on July 19th. There was an area of pavement about 5’ by 5’ that rose over 2 feet, which was caused by the heat causing expansion in the brick base of the road. The invoice from R. A. Bores was $515. Council received a request from Sutton to freshen up the crosswalk across route 4 for their employees. Gary explained he is having issues procuring paint from Sherwin Williams.

Parks: Councilman Love let council know the purchase order is being created to purchase the bleachers.

First read of RES 2022-9: TAX LEVY IN EXCESS OF THE TEN MILL LIMITATION FOR PROVIDING PARK OPERATION. Motion by Councilman Sanders, seconded by Councilman Love to suspend the three-read rule. Vote: 5-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman Beamer to declare an emergency on RES 2022-9. Vote: 5-0. Motion carried.

Motion by Councilman Sanders, seconded by Councilman Love to adopt RES 2022-9. Vote:5-0. Motion carried.

Mayor Frisch explained PEP’s risk services suggested some changes to the parks.

Ensure security at the pool area be improved, signage stating pool is closed, address gaps in fencing to reduce trespassing, specifically at the rear of the property there is too much slack in the gate, consider covering the pool. If the pool remains uncovered consider a ladder for potential enter/exit.

Ensure Playground equipment and use zone conditions are improved so they are in compliance with Public Playground Safety Standards, pea gravel used as fall protection did not comply with minimum depth standards. Broken steppingstone equipment should be removed as it is inoperable. Monitor rusted and deteriorated conditions on main playset piece.

Ensure life safety improvements are addressed at the storage building adjacent to Water Plant; all flammables and combustibles are stored in approved cabinet. Ensure the material next to the electrical panel be relocated at least with 3 foot clearance.

Ensure safety improvements are addressed at Myers Park Baseball Field, repair the damaged riser leading to the 2nd floor of the concession stand area.

Ensure outlets at Myers Park Shelter House are covered.

Gary stated when he went out to review the playground he noticed the slide is in poor shape. Decision about what funds were available to make the changes. Councilman Love volunteered to price out the necessary upgrades.

Councilman Bulger stated he spoke with a deputy last week about illegal activity at Honeycreek park. Someone is gathering back there having fires and leaving empty beer containers. He asked if Council should consider signage stating park hours. He also asked if the Norfolk Southern railroad should be notified. Councilman Love agreed to look into signs.

 

Trees: Councilman Beamer said he did get in contact with the resident on North Main and let them know the tree was on the list to come down.

 

Fire: Councilman Bulger stated there is a meeting last week and they paid bills. They had 20 fire/ems runs.

 

EMS: Councilman Love requested to discuss in executive session.

 

Cemetery: None

 

Personnel: Councilman Love made a motion at 8:30 p.m. enter into executive session to discuss personnel and ems, motion seconded by Councilman Bulger. Vote: 5-0. Motion carried.

Councilman Love made a motion to hire Robin Bulger starting Thursday, July 28, 2022 at 10:15 p.m. as Billing Clerk at $13 an hour, Councilman Beamer seconded. Vote:3-0 with Councilman Bulger abstaining, and Councilman Stanfield no longer in attendance. Motion carried.

First read of ORD 2022-11 Ordinance Appointing a Village Solicitor

 

Zoning Commission: none

 

Finance & Rule: Cash balance of all funds $1,519,668.84. All funds includes CDs and reserved or restricted funds, and debt reserve funds.

RES 2022-10 AMENDED APPROPRIATIONS FO Hatfield explained the request includes the money received from Seneca County for the bleachers and also the 2nd distribution of American Rescue Funds. Motion by Councilman Love, seconded by Councilman Sander to suspend the three-read rule. Vote: 5-0. Motion carried.

Motion by Councilman Love, seconded by Councilman Bulger to declare an emergency on RES 2022-10. Vote: 5-0. Motion carried.

Motion by Councilman Love, seconded by Councilman Bulger to adopt RES 2022-10. Vote:5-0. Motion carried.

FO Hatfield asked Council to consider the request from the State Auditor to contract for the next audit period with Perry and Associates. Councilman Stanfield suggested having the State conduct the Audit. Council agreed to move forward pending the cost.

 

Water & Sewer: Councilman Beamer said he received sample bid documents related to selling the water and sewer operations. He agreed to send copies to council. He reiterated this documents are SAMPLES.

Penalties 615 Buckeye Drive in the amount of $66.13

Motion by Councilman Beamer, seconded by Councilman Bulger. Vote: 5-0. Motion carried.

Council discussed suspending penalties with the post office being out of commission the lack of a billing clerk to send the bills. Councilman Stanfield pointed out that some residents have mailboxes on the street, so should the same exception be allowed to those with access to their mail. Councilman Sanders asked if anyone has complained. At this point, there have been no complaints from residents, so council decided to hold off on a decision.
